FCRA Disclosure & Authorization

A standalone disclosure that a background check will be conducted, plus written authorization from the candidate before a consumer report is obtained.

State-Specific Consent Requirements

Additional forms, timing rules, language mandates, and other requirements that apply beyond federal FCRA.

Electronic Consent Capture

Electronic signatures, timestamps, IP addresses, and form versions captured and stored for compliance documentation.

Adverse Action Support

State-Specific Requirements

Federal FCRA is the floor.

Correct timing for criminal-history inquiry and background checks where a conditional offer or other sequence is required.

Adverse Action Process

When a report may affect a hiring decision, the timing matters.

FCRA requires a multi-step process. Skipping steps or getting the timing wrong creates litigation risk.

Pre-Adverse Action Notice

Provide the candidate with a copy of the report, a Summary of Rights under FCRA, and notice that adverse action is being considered.

Waiting Period

Give the candidate a reasonable period, typically 5 business days though some states require longer, to review the report and dispute inaccuracies.

Final Adverse Action Notice

If the decision stands, send the final notice with the CRA’s contact information, a statement that the CRA did not make the decision, and the candidate’s dispute and free-report rights.
