The first week, mapped
The employee, employer, and authorized representative each have a part to play. A visible process helps keep required actions in order.
Section 1 must be completed by the employee no later than the first day of employment.
Section 2 must be completed by the employer within 3 business days of the employee’s first day.
Reverification applies to specific temporary work authorization, not to all documents, and must be completed on or before expiration.

Telling employees which documents to present is illegal document abuse. Employees choose which acceptable documents to show.
Some documents cannot be accepted if expired. Document types and expiration dates need a consistent review.
Requesting more documents than required is a violation. One List A document, or one List B plus one List C document, is sufficient.
Failing to reverify work authorization before it expires creates avoidable risk. Track the applicable expiration date before the deadline.
Different locations or managers applying different standards can lead to inconsistent treatment. A shared workflow supports consistent practice.
E-Verify follows I-9
E-Verify uses information from Sections 1 and 2 of the I-9. The I-9 must be completed first; E-Verify is not a replacement for it.
Submit within 3 business days of the employee’s start date, or the I-9 completion date, whichever is later.
Employment Authorized closes the case. A Tentative Nonconfirmation requires additional steps.
A TNC requires notice and an opportunity to contest. No adverse action may be taken during the process. An employee who contests has 8 federal business days to visit SSA or contact DHS.
Audit retention
I-9 forms must be retained for 3 years from the hire date or 1 year after termination, whichever is later. Retention is a lifecycle, not a filing cabinet.
